Legal basis

The Federal Act on Radio and Television (RTVA) governs the collection of radio and television reception fees. You can find further details in the relevant ordinance (RTVO).

Anyone who owns a device which allows to listen to the radio or to watch television is obligated to register and pay the reception fees. This also applies to companies, which are obligated to pay for either professional or commercial reception.

This interpretive document provides a summary of how we apply the legal provisions in practice (available in german, french and italian).

Data protection and freedom of information acts

Billag AG is an independent organisation external to the federal administration. As the collection agency for radio and television reception fees, we have the status of an authority pursuant to art. 1 para. 2 let. e of the Federal Act on Administrative Procedure (APA). As a result, we are subject to the Federal Act on Data Protection (FADP) and, to a certain extent, to the provisions of the Federal Act on Freedom of Information in the Administration (FoIA).

Federal Act on Data Protection (FADP)

As part of its mandate, Billag AG has the right to collect and process personal data (art. 69 para.1 oRTVA and art. 65 ff. oRTVO in conjunction with art. 109b para. 2 RTVA). On the basis of Art. 69 para. 1 oRTVA in conjunction with art. 109b para. 2 RTVA, Billag AG can process personal data in order of ensuring the obligation to register and pay fees and collecting the reception fees. In principle, Billag AG is not permitted to share this data with third parties (art. 69 para. 3 oRTVA in conjunction with art. 109b para. 2 RTVA). That's why we take organisational and technical measures to protect personal data against any form of abuse.

Federal Act on the Freedom of Information in the Administration (FoIA)

The FoIA is intended to ensure transparency regarding the activities of the federal administration. Limitations apply if the free opinion-forming and decision-making processes of an authority or an organisation would significantly be impaired or if it would lead to the disclosure of professional, trade or industrial secrets.

The FoIA applies to organisations external to the federal administration that perform public functions, provided that they issue decrees. As this applies to Billag AG, the company is also subject to the provisions of the FoIA.
